1. Introduction
This Privacy Policy describes how Shoot Indoors KOP LLC ("Shoot Indoors," "Company," "we," "us," or "our") collects, uses, discloses, and protects information when you visit ShootIndoorsPhilly.com (the "Website"), purchase products or services, enroll in a class, hold a membership, sign our waiver, or enter our facility at 514 Shoemaker Road, King of Prussia, PA (collectively, the "Services").
By using the Services, you acknowledge that you have read and understood this Privacy Policy.
This Policy should be read together with:
- the Electronic Liability Release, Hold Harmless & Participation Agreement (the "Waiver"), accessible through the "Complete Waiver" link on ShootIndoorsPhilly.com;
- our Store Policy and Refund Policy; and
- our Customer Code of Conduct and posted range rules.
Important: Section 15 of the Waiver contains your consent to audio and video recording and a license to use your likeness. Section 13 of the Waiver governs disclosure of your information to law enforcement. Those Waiver provisions are summarized in Sections 6, 7, and 8 below and control where this Policy and the Waiver address the same subject.
2. Definitions
- Account — a unique account created for you to access the Services, including membership accounts.
- Personal Data — information relating to an identified or identifiable individual.
- Usage Data — data collected automatically by the Website or its infrastructure.
- Cookies — small files placed on your device that record information about your use of the Website.
- Service Provider — a third party that processes data on our behalf (for example, our payment processor, electronic waiver platform, membership plugin, email platform, or hosting provider).
- Waiver — the Electronic Liability Release, Hold Harmless & Participation Agreement executed by every participant.
- You — the individual or entity accessing or using the Services.
3. Information We Collect
3.1 Information you provide directly
- Identity and contact data: first and last name, email address, telephone number, mailing address, city, state, ZIP code, and date of birth.
- Government identification: a valid government-issued photo ID is required to use the range. As stated in the Waiver, the ID is held at the front desk during your visit and must be retrieved before departure. We visually inspect it and do not retain a copy unless required by law or in connection with a regulated transaction.
- Nationality and export-control data: foreign nationals must comply with applicable ITAR and export control laws, and we may collect citizenship, immigration status, or visa information as needed to verify eligibility for range access. We collect such data only for that purpose and do not use it for marketing.
- Waiver and eligibility data: information submitted through the Waiver, including initials and electronic signature, emergency contact information, attestations that you are not under the influence of drugs (including THC) or alcohol, attestations that you are not prohibited from possessing firearms under 18 U.S.C. § 922(g) or 18 Pa.C.S. § 6105, prior training history, and confirmation that you are not experiencing emotional distress, suicidal ideation, or impairment that would make participation unsafe.
- Health and medical data: disclosures about hearing, vision, medical, or psychological conditions that may affect safe participation, physician clearance where applicable, training limitations reported to an instructor, and records of emergency medical care or injury at the facility. Failure to disclose such conditions is a material breach of the Waiver.
- Parent and guardian data for minors: identity and relationship of the parent or legal guardian, guardianship attestation, medical-decision authority, and consent on the minor's behalf. Minors must be 10 to take a training class and 12 to shoot on the range with a guardian without an instructor.
- Class, training, and membership data: enrollments, attendance, certifications, safe shooter and Gold Safe Shooter Program status, instructor notes, membership tier, Buddy Program eligibility, and renewal status.
- Transaction data: purchases, reservations, gift card balances, order history, billing details, and assessed fees (including damage, prohibited ammunition, and biohazard cleanup fees).
- Safety, incident, and conduct records: RSO reports, range rule violations, safety interventions, denial or revocation of access, removals, and trespass notices.
- Communications: emails, text messages, voicemails, web-form submissions, reviews, and support requests.
3.2 Payment information
Payments are processed by Stripe, Inc. and other PCI-DSS compliant processors. Card numbers, expiration dates, and security codes are transmitted directly to the processor. Shoot Indoors does not collect, store, or have access to your full payment card number. We receive only limited transaction data such as the last four digits, card brand, authorization result, billing name and postal code, and transaction amount. Stripe's handling of your data is governed by the Stripe Privacy Policy.
3.3 Audio and video surveillance
Our facility is under audio and video recording and surveillance throughout, including the lobby, retail area, classrooms, and range bays, for safety, security, training, evidentiary, and operational purposes. Notice is conspicuously posted at each entrance and within the facility. Recording devices are not installed in restrooms or changing areas.
By entering the premises after receiving this notice, and by executing Section 15 of the Waiver, you give prior consent to the interception, monitoring, and recording of oral, wire, and electronic communications you make or participate in on the premises, within the meaning of 18 Pa.C.S. § 5704(4).
You further acknowledge that our premises are private property and that the lobby, retail area, classrooms, and range bays are shared, open, actively supervised spaces where conversations are routinely overheard by staff, Range Safety Officers, and other patrons. In those areas you should have no expectation that a conversation is private or free from interception. Please do not conduct conversations on our premises that you wish to keep private.
If you bring a guest or companion who is not signing the Waiver, please inform them of this notice before they enter. We may require any person entering the premises to acknowledge this recording notice as a condition of entry.
Recordings are retained and used as evidence in response to incidents, injuries, claims, insurance matters, chargebacks and payment disputes, arbitration, and lawful law enforcement requests, as authorized by Sections 13, 15, and 17 of the Waiver.
3.4 Information collected automatically online
Usage Data may include your IP address, browser type and version, device identifiers, operating system, pages visited, referring URLs, dates and times of access, time spent on pages, and diagnostic data. On mobile devices this may include device type, mobile device unique ID, mobile IP address, and mobile browser type.
3.5 Information from third parties
We may receive information from service providers, payment processors, our electronic waiver platform, independent third-party instructors who teach at our facility, social media services through which you interact with us, advertising platforms, and certification bodies.
4. Electronic Signatures and Records
The Waiver is executed electronically and is legally binding under the Pennsylvania Uniform Electronic Transactions Act and the federal E-SIGN Act. As provided in Section 18 of the Waiver, we may store, archive, and reproduce your signed Waiver electronically, and digital copies hold the same legal force as originals. The same applies to your electronic acceptance of our Store Policy and Refund Policy at checkout.
5. Cookies and Tracking Technologies
We use cookies, web beacons, pixels, tags, and scripts to operate the Website, remember preferences, secure accounts, and analyze traffic.

You may set your browser to refuse cookies. If you do, some parts of the Website may not function. Where a browser-based opt-out preference signal such as Global Privacy Control (GPC) is transmitted, we treat it as a valid opt-out of sale and of sharing for targeted advertising to the extent applicable law requires. There is no common standard for "Do Not Track" signals, and we do not otherwise respond to them.
6. How We Use Personal Data
We use Personal Data to:
- provide, maintain, and improve the Services;
- create and manage your Account, membership, and program enrollments;
- perform our contract with you, including orders, reservations, class enrollments, gift cards, and membership billing;
- verify age, identity, nationality and export-control eligibility, and legal eligibility to possess or handle a firearm;
- administer and retain Waivers, safety records, incident reports, and conduct records;
- assess and collect authorized fees, process payments, prevent fraud, and respond to chargebacks and disputes;
- contact you about purchases, reservations, schedule changes, safety notices, and account matters;
- send marketing and promotional communications, subject to Section 8;
- maintain the safety and security of our facility, staff, and customers, including audio and video surveillance and documentation of safety interventions;
- use recordings of your likeness, image, voice, or appearance for lawful business purposes as licensed under Section 15 of the Waiver, including safety documentation, training, marketing, advertising, promotional materials, and social media;
- comply with legal, regulatory, insurance, tax, and recordkeeping obligations; and
- evaluate or conduct a merger, acquisition, financing, restructuring, or sale of assets.
Legal bases (where applicable): performance of a contract, compliance with legal obligations, our legitimate interests in operating a safe and lawful business, and your consent where consent is required.
7. How We Disclose Personal Data
We do not sell your Personal Data for money. We may disclose it to:
- Service providers — payment processing (Stripe), website hosting, membership and e-commerce platforms, the electronic waiver provider, point-of-sale and scheduling systems, email and SMS platforms, analytics and advertising providers, and accounting services (including QuickBooks), each bound to use the data only to provide services to us;
- Independent third-party instructors who teach classes at our facility, limited to what is necessary to deliver and document the class. As stated in Section 9 of the Waiver, these instructors operate independently and are not our employees or agents;
- Financial institutions, card networks, and payment processors — as expressly authorized by Section 17 of the Waiver, we may submit your Waiver, surveillance records, and transaction documentation as evidence in response to any chargeback or payment dispute;
- Insurers, attorneys, arbitrators, and claims administrators, in connection with an incident, claim, arbitration, or enforcement of the Waiver;
- Law enforcement — consistent with Section 13 of the Waiver, we share your information with law enforcement in response to a specific, lawful, written request or subpoena. We may also disclose Personal Data where otherwise required by law or court order, or where we believe in good faith that disclosure is necessary to prevent imminent harm, protect the personal safety of any person, report a suspected crime occurring on our premises, or defend our legal rights;
- Acquirers in a business transaction, with notice before your data becomes subject to a different privacy policy;
- Affiliates and business partners, subject to this Policy; and
- Anyone else, with your consent.
8. Marketing and Electronic Communications
- Email: every commercial email includes a functioning unsubscribe mechanism and our physical mailing address, consistent with the CAN-SPAM Act. Opt-out requests are honored promptly.
- SMS/text: we send marketing texts only with your prior express written consent, consistent with the Telephone Consumer Protection Act (TCPA). Reply STOP to opt out; message and data rates may apply.
- Transactional messages: order confirmations, receipts, reservation and class notices, safety alerts, fee notices, and billing notices are not marketing and may continue after you opt out of marketing.
- Likeness in marketing: the license you grant in Section 15 of the Waiver is separate from marketing email consent. Opting out of marketing emails does not revoke that license or limit our retention of surveillance recordings for security or legal purposes.
9. Your Privacy Rights
Depending on your state of residence, you may have the right to know and access the Personal Data we hold about you, receive a portable copy, correct inaccuracies, request deletion subject to legal exceptions, opt out of targeted advertising or the sale or sharing of Personal Data, opt out of certain profiling, and be free from discrimination for exercising these rights.
How to exercise a right. Call (484) 965-9638 or write to Shoot Indoors KOP LLC, 514 Shoemaker Road, King of Prussia, PA 19406, Attn: Privacy Request. We will acknowledge your request and respond within the time required by applicable law (generally 45 days, extendable once where permitted). We may need to verify your identity. An authorized agent may submit a request with proof of authorization.
Appeals. If we deny your request, you may appeal by replying to our response or writing to the address above, Attn: Privacy Appeal. We will inform you in writing of the outcome and how to contact your state Attorney General.
Limits on deletion and opt-out. We may retain Personal Data notwithstanding a deletion request where retention is necessary to comply with law, complete a transaction, preserve safety and incident records, resolve disputes or arbitration, maintain insurance and liability records, or enforce the Waiver and our agreements. In particular:
- Signed Waivers, safety records, incident reports, and surveillance recordings subject to a legal hold are retained for the full period of any applicable statute of limitations and are generally not deleted on request.
- The likeness license granted under Section 15 of the Waiver is described in that agreement as perpetual and irrevocable. If you wish to discuss removal of specific promotional content, contact us and we will consider the request in good faith, but we are not obligated to withdraw material already published.

11. Children's Privacy
The Website and online store are not directed to children under 13, and we do not knowingly collect Personal Data online from children under 13. If you believe a child under 13 has provided us Personal Data online, contact us and we will take steps to delete it.
Separately, our facility admits minors under the conditions in the Waiver: a minor must be at least 10 to take a training class and at least 12 to shoot on the range with a guardian and without an instructor, and a parent or legal guardian must execute the Waiver, remain present, and maintain direct supervision and control at all times. Information about a minor collected in that context is provided by the parent or legal guardian, who also grants recording and likeness consent on the minor's behalf. As stated in Section 7 of the Waiver, Shoot Indoors does not assume care, custody, supervision, or control of any minor.
12. Firearm Sales
We do not currently sell firearms or process firearm transfers, and we therefore do not collect background check or transfer records. This Policy will be updated before any such service is offered.
13. Data Security
We use commercially reasonable administrative, technical, and physical safeguards, including TLS/HTTPS encryption of the Website, restricted internal access on a need-to-know basis, controlled handling of IDs held at the front desk, secured surveillance systems, and a PCI-DSS compliant payment processor so that card data does not reside on our systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. We will notify affected individuals of a breach of unencrypted personal information as required by the Pennsylvania Breach of Personal Information Notification Act.
14. Third-Party Links and Services
The Services may link to websites we do not operate, including our payment processor, electronic waiver platform, and social media pages. We are not responsible for their content or privacy practices.
15. International Transfers
We operate in the United States. If you access the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.
16. Disputes Relating to This Policy
Claims arising from your participation at our facility are governed by the dispute-resolution terms of the Waiver, which require binding arbitration in Montgomery County, Pennsylvania and include a jury trial waiver. This Policy is otherwise governed by the laws of the Commonwealth of Pennsylvania. Nothing here limits your ability to contact a regulator or state Attorney General.
17. Changes to This Policy
We may update this Policy from time to time. We will post the revised Policy on this page and update the "Last Updated" date. For material changes, we will provide a prominent notice on the Website and/or by email before the change takes effect.
